Islam miras hukuku ile türk medeni kanunu miras sisteminin mukayesesi

Turkey adopted Swiss Civil Code with some minor alterations in 1926. The law of inheritance, among others, was regulated in the new (Turkish) civil code. Indeed, there are definite differences between Turkish and Islamic Laws of Inheritance. These differences include “intestate and testate succession”, “forced heirship”, “share difference between the men and women”, “adoption”, “disinheritance”, “disclaimer of inheritance” and so on. This study aims at comparing these two laws of inheritance as to these subjects.
